Agent Appointment, Monitoring and Termination Policy

PURPOSE
This policy sets out Global Leadership Institute’s (GLI) requirements to ensure agents that represent GLI are aware of their responsibilities. This ensures GLI’s compliance with the National Code for CRICOS registration. An agent is a person or organisation (in or outside Australia) who recruits overseas students and refers them to education providers. In doing so, the education agent may provide education counselling to overseas students as well as marketing and promotion services to education providers. Education agent does not refer to an education institution with whom an Australian provider has an agreement for the provision of education (that is teaching activities).
PRINCIPLES
GLI is committed to:
· taking reasonable measures to ensure that the education agents used have an appropriate knowledge and understanding of the Australian international education industry;
· not using education agents that are dishonest or lack integrity;
· entering into a written agreement with an education agent and the specified responsibilities;
· not accepting students from agents or enter into an agreement with an agent who GLI knows or reasonably suspects the agent to be:
a) being engaged or has been previously engaged in dishonest practices.
b) deliberately facilitating the enrolment of a student where it clearly conflicts with Standard 7, of the National Code;
c) facilitating the enrolment of a student who the Agent believes will not comply with the conditions of the student visa;
d) using the Provider Registration and International Students Management System (PRISMS) to create Confirmation Of Enrolments (COE’s) for other than genuine students; or
e) providing immigration or migration advice where not authorised to do so under the Migration Act 1958.
ROLES AND RESPONSIBILITIES
· The Registrar or delegated authority of the Institute will regularly monitor and evaluate the appointment, monitoring and termination of agents.
· All staff of GLI are responsible to notify the President or Registrar should they suspect or obtain knowledge with regards to an agents’ non-compliance with GLI stipulated policies or government laws and legislations.

WRITTEN AGREEMENTS
GLI will ensure that the Education Agent Written Agreement includes:
·     responsibilities of the registered provider, including compliance with the ESOS Act and National Code 2018;
·     responsibilities of the agent in representing GLI;
·     clear explanations regarding monitoring and correcting;
·     termination conditions (immediate upon failure to meet The National Code 2018 or Migration Act 1958);
·     circumstances under which information about the education agent may be disclosed.
 
MONITORING
GLI will use the methods below to monitors its Education Agents:
·     regular communication with Agents;
·     student surveys;
·     data from PRISMS;
·     performance and progression of students;
 
DISMISSAL
GLI will immediately take corrective action or dismiss an agent in writing if the agent is negligent, careless, incompetent, dishonest or unethical, including the deliberate attempt to recruit a student where this clearly conflicts with the obligations of registered providers under National Code Standard 7. GLI may also terminate an agent agreement if a visa application for a student referred by the agent is refused by The Department of Home Affairs for reasons related to fraudulence or suspicion of fraud.
Any GLI staff member who becomes aware of possible breaches of this policy must report it to their supervisor. Any GLI staff member or student who violates this policy will be subject to formal disciplinary action. Penalties may range from restriction from campus or in some more serious instances criminal or civil proceedings. GLI will report illegal activities and corrupt conduct to appropriate authorities.

Professor Grant Pitman

Professor Grant Pitman is the president of the Global Leadership Institute. He has held senior leadership roles in government such as Chief Superintendent of Police and Director of Strategic Planning ICT in the Queensland Police Service;

  • Varied list of contributions to law enforcement, including disaster management, auditing and finance, organizational reform, education and human resources, and policy development
  • National, state, and regional levels of professional service, including the Ipswich Economic Forum, the Brisbane Airport Emergency Planning Committee, the National Emergency Communications Working Group, the National Police Drug and Alcohol Task Force, and the Police Education Advisory Council.

He has a Ph.D. and Master of Administration from Griffith University. He is a well-versed researcher and has published numerous articles and journals.

Professor Shane Doyle

Professor Geoff Dean

Professor Geoff Dean is the Managing Director of VP Consulting and Adjunct Professor at Griffith University with expertise in policing, security and terrorism studies.

Dr. Jason Hartley

Jason Hartley is lecturer in criminology at Griffith University in Brisbane, Australia. Jason is a former police officer with 23 years of experience, and has trained personnel for deployment in Timor Leste, the Solomon Islands, Iraq and Afghanistan. Jason specializes in, and has published on engagement with Muslim communities, Indigenous Polynesian approaches to rehabilitation and reducing recidivism, and Asian Organised Crime. Jason also completed a community internship in Hebron on the West Bank.

Simone Fulcher

Simone Fulcher is the Campus Manager at Global Leadership Institute responsible for managing the day-to-day operations for the campus. Simone has previously worked in the education sector for over 5 years where she has enjoyed helping young minds realise their potential. Simone also has a history of volunteer work assisting various communities in improving their quality of life in places such as New South Wales, Guam, and Palau. Simone still enjoys volunteering, currently organising events for young adults in Southeast Queensland and helping them form connections their fields of interest.
